Course Outline Information

Learner objectives

A general understanding of bad debts, collections and foreclosures respecting condominium associations and homeowners associations subject to Chapters 718 and 720, Florida Statutes. An understanding of the collection process, including, but not limited to, initial demand letters, liens, foreclosures, receiverships and mortgage foreclosures.

Materials and Methods

The course will be taught in a lecture forma with the participants following the outline entitled “Bad Debts, Collections & Foreclosures” attached hereto. The course is estimated at 2 hours. The course participants may ask questions during and after the completion of the course. The course participants will have a 10 minute break after 1 hour of lecture. The participants are also encouraged to ask questions during the break.

Course Evaluation

The course participants will be able to ask questions during and after the course, and during the 10 minute break. There will also be hypothetical questions and scenarios discussed during the course. The participants will have the opportunity to give input on how they would handle the situation and get feedback from the course providers on the accuracy and legal validity of such strategies.

Subject Matter

Bad debts, collections and foreclosures in condominium associations pursuant to Chapter 718, Florida Statues, and homeowners associations pursuant to Chapter 720, Florida Statutes.

Learner objectives

The objective of the course is for the participants to gain a general understanding of the claims making process, the property manager’s role and the importance of the insured’s compliance with the policy’s post-loss conditions as the failure to do so may provide the insurer with a total defense to coverage and result in a denial of the claim and potential liability on the part of the property manager. Additionally, the property managers will be taught how to maximize the Association’s chances of recovery.

Materials and Methods

This symposium course will be taught in a panel and interactive format with the participants being provided with a sample fact pattern and standard form policy provisions. The course is estimated at 2 hours. The course participants will be given scenarios and asked questions during the course. The participants will also be given the opportunity to ask questions during the course and after completion. The course outline provides the anticipated times for each section as well as the number of and breaks that will be given.

Course Evaluation

The course participants will be given a number of hypothetical scenarios based on the sample fact pattern and will be asked to identify a number of problematic issues and to give their input as to how best to resolve these problems. The participants will receive feedback from the course providers on the appropriateness of their responses, and guidance as to the correct or better responses to the various scenarios.

Insurance policies, the claim process, insurance adjusting and insurance law, discussion of relevant case law and statutes.

Laws regarding transfer fees and security deposits, 4. Fair Housing Laws, and 5. Required accommodations and modifications to dwellings.

The course will be taught in a lecture format with participants following the enclosed Power Point. The course is estimated at 2 hours. The participants are encouraged to ask questions during the course.

Course Evaluation

The participants may ask questions during and after the course. An evaluation form is also enclosed.

Record Keeping Requirements

  • Course records and attendance rosters will be maintained for a minimum of four years as per rule 61-6-015(4)(d), Florida Administrative Code.
  • Although rule 61-6-015(4)(d), Florida Administrative Code only requires four years of records retention; Rosenbaum Mollengarden, LLC course attendance rosters will be maintained for a minimum of seven years.
  • Records will be maintained in the corporate offices of Rosenbaum Mollengarden located at 250 South Australian Avenue West Palm Beach, FL 33401 in a locked file cabinet.
  • Each course participant will be advised that they must maintain their certification of course completion for five years from the date received.
